Delaware Traffic Court
Like with every state, Delaware has a traffic court to handle
violations on the road. Delaware’s Traffic Court is part of the Court
of Common Pleas, which also handle misdemeanors, preliminary hearings
for felonies, lawsuits, and certain types of appeals. If you’ve
received a traffic violation, take a moment to understand how Delaware
Traffic Court works.
Duties of the Court
The Delaware court system created Traffic Court in 2003 to help with
the overflow of traffic ticket cases. Delaware Traffic Court takes
place every Tuesday takes care of most traffic cases. Delaware DUI
tickets, however, are handled under different courts of law. With the
Delaware Traffic Court, the Court of Common Pleas is able to move cases
through the system faster. The court combines arraignment and trials on
a single day to save time, with pleas heard in the morning and resolved
if possible.
However, it is the duty of the Delaware court to give you a fair trial
if you decide to plead not guilty. Trials take place in the afternoon
of your morning arraignment, so it is important for you to take all of
your witnesses, documents, and evidence to court with you.
You’re only required to go to court if you want to plead guilt or if
you are not offered voluntary assessment. The court hears your case if
you plead guilty, accepts voluntary assessment bill payments, and takes
care of adding points you your license if necessary.

You may also be eligible through the state’s Delaware Probation before
Judgment program, and if you want, you can appeal your conviction
within 15 days of the trial if your fine is over $100 or you were
sentenced to jail time.
