DUI/DWI Basics
DUI/DWI tickets are issued in Delaware when you’re caught drinking
and driving. DUI stands for “driving under the influence” and DWI
stands for “driving while intoxicated.” Some states distinguish between
these two terms, but in Delaware, they are one and the same. You can
get a DUI ticket for not only drinking and driving, but also for doing
drugs and driving. Even legal, prescription drugs might be a downfall
for you, if they affect your driving unsafely.
Delaware DUI tickets are not given out just to people who look and act
drunk. While these indicators, along with field sobriety tests, can
help an officer determine whether or not you might be drunk, your
official DUI status is based on you BAC – the amount of alcohol in your
blood. This can be tested through breath, blood, or urine tests, and by
law, you have to take the chemical test if you are asked to do so.
Refusal means that your license is automatically revoked.
